Hire Choices ("Hire Choices") has developed this Privacy Policy ("Policy") to explain how we collect, use, store, and share personal information obtained through our websites. This Policy applies solely to information collected through websites owned and operated by Hire Choices (referred to collectively as the "Sites," as outlined in our Terms and Conditions). It does not extend to data collected via other methods, such as offline interactions, third-party websites, or communications you send outside of the Sites. Hire Choices adheres to all relevant data protection laws.

By using or accessing the Sites, you acknowledge and agree to the practices described in this Policy. You also consent to Hire Choices' use and sharing of your personal information and agree to receive communications from us, which may include—but are not limited to—emails and text messages, as further outlined below.

COLLECTION OF PERSONAL INFORMATION

"Personal Information" refers to data that can directly or indirectly identify an individual. This may include, but is not limited to, unique identifiers such as your name, ID number, location data, online handle, or characteristics tied to your physical, physiological, genetic, mental, economic, cultural, or social identity.

To deliver services efficiently and offer job-related information tailored to your interests, Hire Choices may gather certain types of Personal Information. This includes, though is not limited to, your name, email address, phone number, mailing address, IP address, browser details, most frequently visited pages, visit duration and timing, and your geographic location. Such data, provided by you during your interactions with the Sites, may help identify you either on its own or when combined with other data.

Hire Choices also collects data automatically based on how you use the Sites. This may include behavioral patterns and technical data, which the company uses for internal analysis related to user demographics, preferences, and activity. Additionally, Hire Choices may collect financial details, such as credit or debit card information, when necessary.

If you enable location services on your mobile device, and you access the Sites through that device, Hire Choices may collect precise location data—even when the Sites are running in the background or foreground.

Should you choose to log in or connect to the Sites through a third-party platform like Facebook, Google, or another social media service ("Social Networking Site"), Hire Choices will receive the information you authorize that platform to share. This may include details such as your public profile, email address, birthday, current city, work history, or educational background. Once received, this data becomes part of your account with Hire Choices and is treated as Personal Information under this Policy.

The specific data shared through a Social Networking Site may depend on your privacy settings within that platform. You may disconnect your social media account from your Hire Choices account at any time through the privacy or settings options provided by the Social Networking Site. Please note that if you access the Sites through third-party platforms, devices, or services, those parties may collect information about you in accordance with their own privacy policies.

USE OF DISCLOSURE OF PERSONAL INFORMATION

Hire Choices, along with trusted third parties such as Microsoft and Google, may collect and use your Personal Information to enhance your experience on the Sites, personalize content, and ensure the security and functionality of the platform. By using the Sites, you consent to the use of your Personal Information by Hire Choices and its partners for purposes including, but not limited to, sending you targeted communications that may align with your interests—such as job opportunities, relevant services, advertising, or resources related to career advancement—and for sending administrative updates relevant to your account or activity on the Sites.

By continuing to access or use the Sites, you expressly agree to receive communications from us by email, text message, or any other method of contact you have provided. If at any time you prefer not to receive such messages, you may opt out by following the instructions provided in each communication.

Hire Choices may also create and distribute aggregated, anonymized data—such as general statistics related to user education levels, job roles, locations, or professional experience—for reporting purposes. These reports do not include any information that directly identifies individuals.

We may share your Personal Information with select third-party vendors who support business operations, including but not limited to advertisers, payment processors, banking institutions, and technical support service providers, especially for the processing of transactions or payments related to the services we offer. In all such cases, recipients of the data are required to treat your Personal Information as confidential and protect it appropriately.

We may also share your Personal Information with service providers who are contractually or legally obligated to handle your data securely and only use it according to our instructions or with your consent.

Please be aware that when you choose to publicly share Personal Information (for example, by uploading a resume or posting contact details on the Sites), that information may be accessed and used by others. This could result in unsolicited communications, for which Hire Choices is not responsible. Additionally, if you accessed the Sites via a link from one of our affiliates, we may share your data with that affiliate, who may use it in accordance with their own privacy policy.

Data collected through short code messaging services will not be shared with any third parties for marketing purposes.

Finally, Hire Choices reserves the right to disclose your Personal Information when we believe it is legally required, necessary to cooperate with law enforcement, or essential to protect the safety, rights, or interests of our company or our users.

ACCESS TO YOUR PERSONAL INFORMATION

As a user of the Sites, you are entitled to the following rights regarding your Personal Information:
(i) the right to obtain a copy of the data Hire Choices has collected about you;
(ii) the right to request that Hire Choices update any details you believe to be incorrect or incomplete;
(iii) the right to ask for your Personal Information to be deleted;
(iv) the right to limit how Hire Choices processes your Personal Information; and
(v) the right to request that your Personal Information be transferred to another entity or sent directly to you.

PERSONAL INFORMATION STORAGE

Hire Choices stores the Personal Information you submit through its Sites on its secure data-hosting systems. Unless restricted by applicable federal, state, or local laws, Hire Choices may retain your Personal Information—including resumes, cover letters, and other uploaded documents—for an indefinite period.

ADDITIONAL PRIVACY RIGHTS

Depending on your location, you may be entitled to specific privacy rights under applicable data protection and privacy laws in relation to the information you share with Hire Choices.

For California Residents (CCPA):
If you reside in California and your Personal Information is governed by the California Consumer Privacy Act of 2018 (“CCPA”), you are encouraged to review this entire Privacy Policy to understand the types of Personal Information Hire Choices may have collected about you over the past 12 months, including the sources of that information. Hire Choices collects this data for the business-related and commercial uses outlined in this Policy and may share it with third parties, as described herein. However, Hire Choices does not sell your Personal Information as defined by the CCPA and will not do so without giving you the option to opt out.

Subject to certain conditions, the CCPA grants California residents the following rights:
To request details about the categories or specific pieces of Personal Information Hire Choices collects, uses, or shares;
To request the deletion of your Personal Information;
To opt out of any sale of your Personal Information, should it occur;
To not face discrimination for exercising any of these rights.

Marketing and Third-Party Advertising:
Hire Choices may send you personalized messages, including offers, promotional materials, and product or service updates. Your Personal Information may also be used for online advertising on the Sites and other digital platforms. You have the option to opt out of marketing communications and to remove your information from Hire Choices' database to avoid future promotional outreach.

Hire Choices may collaborate with third-party advertisers to display targeted ads on its Sites. These ads may include links to external websites. Hire Choices neither endorses nor assumes responsibility for the content, policies, or practices of these third-party sites. Visiting those links is done at your own discretion and risk.

Advertisers may also place cookies on your device when you click through to their websites. These cookies may help them identify your browser and monitor your interaction with advertisements, as well as track your web activity across other websites they partner with. They may combine this browsing data with other collected information. These companies operate under their own privacy policies, and Hire Choices recommends reviewing those policies before engaging with any linked third-party content or consenting to their use of cookies. Hire Choices has no control over the cookies placed by these third-party advertisers and cannot access data stored in them.

Consent-Based Data Processing:
If Hire Choices processes your Personal Information based on your consent, you have the right to withdraw that consent at any time by contacting Hire Choices directly.

All privacy-related requests will be handled in accordance with applicable data protection laws. To verify and process your request, Hire Choices may ask you to provide information to confirm your identity. Where permitted by law, you may also appoint an authorized representative to act on your behalf in exercising these rights.

Hire Choices may utilize cookies, web beacons, and log files to remember your preferences, reduce the need to re-enter information during current or future visits, deliver personalized content, and analyze overall site performance—such as tracking the number of visitors and pages viewed. Cookies may also be used to store non-personal data, such as job postings you've viewed or search queries you've made, in order to suggest relevant job opportunities tailored to your browsing behavior.

These cookies may be used to uniquely identify your browser and evaluate how effective their job listings are—such as tracking whether a viewer eventually becomes a job applicant.

If you prefer not to allow Hire Choices to collect information through cookies, you can opt out by adjusting your browser settings accordingly.

SECURITY OF INFORMATION

Hire Choices uses a combination of physical safeguards, electronic systems, and administrative protocols to help protect the Personal Information collected through its Sites. However, it's important to recognize that no method of communication over the Internet is entirely secure. While Hire Choices is dedicated to safeguarding your privacy, it cannot guarantee—and you should not assume—that any information you transmit or receive will remain completely confidential.

To help protect your sensitive data, we advise against using the Sites to share information that you consider highly confidential or private. Hire Choices is not liable for any harm or losses you or others may experience due to the exposure or unauthorized access of such information.

By using the Sites, you acknowledge and accept full responsibility and risk for your online activities, including any content you submit, access, or share, and your general use of the Internet. You are also solely responsible for maintaining the confidentiality of your account credentials, including your username and password.

Hire Choices will never request your password after your account has been created. For your protection, choose a strong, unique password for your Hire Choices account and avoid using the same password across other platforms or services. Do not share your password with anyone.

CREDIT CARD INFORMATION, USAGE & SECURITY

When you provide credit card details on the Sites to complete a transaction, that information is transmitted directly from your browser to a trusted third-party payment processor. Hire Choices does not store your credit card information on its servers. The payment processor is authorized to use your payment details solely for processing transactions on behalf of Hire Choices and is not permitted to use the information for any other purpose.

OTHER PRIVACY FEATURES ON THE SITES

You are not required to share any personally identifiable information to browse or search for job opportunities on Hire Choices’ websites. Creating an account or logging in is entirely optional, though doing so may grant you access to additional features and opportunities.

CHANGES TO PRIVACY POLICIES

Hire Choices reserves the right to revise, modify, update, add to, or remove portions of this Privacy Policy at its sole discretion and without prior notice. Any changes to this Policy initiated by you will not be valid unless expressly agreed to in writing by Hire Choices. We recommend reviewing this page regularly to stay informed about our current privacy practices. Your continued use of the Sites signifies your acceptance of the most recent version of this Policy. If you disagree with any part of the Policy once it becomes effective, you must discontinue use of the Sites.

RELEASE

By accessing and using the Sites, you agree to release and hold harmless Hire Choices, along with its owners, affiliates, managers, employees, agents, representatives, successors, and assigns, from any and all liabilities, losses, damages, costs, or expenses (including reasonable attorneys’ fees) that may arise in connection with: (i) the collection, use, processing, storage, retention, disposal, sharing, or disclosure of your Personal Information by Hire Choices or any third-party service provider acting on its behalf; and (ii) any errors, omissions, interruptions, file or email deletions, defects, viruses, delays in transmission, or performance failures, including any claims related to intellectual property or personal privacy laws.

ASSIGNMENT

In the event that Hire Choices sells or transfers the majority or entirety of its assets, or experiences a change in ownership or management control, your Personal Information may be included among the assets transferred. Hire Choices will take steps to ensure that the privacy and security protections outlined in this Policy continue to be upheld during and after any such transition.

DISPUTE RESOLUTION

By accessing and using the Sites, you agree to promptly notify Hire Choices in writing of any claims or disputes related to the Sites or to the collection, processing, storage, retention, sharing, or disposal of your Personal Information by Hire Choices. You further agree to cooperate in good faith with Hire Choices in an effort to resolve any such issues amicably and within reasonable terms. If a resolution cannot be reached, both you and Hire Choices agree to submit the matter to a neutral third-party mediator located in the State of South Dakota prior to initiating any formal legal proceedings.

TARGET AUDIENCE

The Sites are not intended for use by children under the age of 13, and Hire Choices does not knowingly collect personal information from individuals in this age group. The platform is designed for use by adults, including parents or legal guardians. Individuals under the age of 13 are prohibited from accessing the Sites or submitting any personal information to Hire Choices.

GOVERNING LAW; JURISDICTION; VENUE

This Policy, including its interpretation, enforcement, and validity, shall be governed by the laws of the State of South Dakota, excluding any principles related to conflicts of law. Any legal proceedings related to this Policy that are not resolved through the dispute resolution process described above must be filed exclusively in the Circuit Court for Minnehaha County, South Dakota, USA. By using the Sites, you consent to accept service of process in accordance with the procedures outlined in the South Dakota Rules.

WAIVER OF JURY TRIAL

You expressly waive your right to a trial by jury for any claims or disputes that arise from or are connected to this policy or your use of the Hire Choices sites.
